Are lottery outlets obliged entities?

The obliged entity is the gaming operator, in respect of prize payments. But the law also covers operations carried out through agents or intermediaries — so the outlet is not 'off the hook': it operates under the main obliged entity's procedures, and prizes paid at the counter are classic territory for attempted laundering (buying a winning ticket with dirty money is a textbook method).

Are non-resident entities operating in Spain obliged?

Only when they carry out activity in Spain — and then with all the consequences. In the case of foreign entities operating in Spain under the freedom to provide services, the representative before SEPBLAC may be a non-resident.

Special cases: lottery outlets, call shops, co-ownership and non-residents

There are activities where obliged-entity status does not fall where it seems to. Four cases that generate constant queries:

Lottery outlets. The obliged entity is the gaming operator, in respect of prize payments. But the law also covers operations carried out through agents or intermediaries — so the outlet is not "off the hook": it operates under the main obliged entity's procedures, and prizes cashed at the counter are classic territory for attempted laundering (buying the winning ticket with dirty money is a textbook method).
Call shops sending remittances. The obliged entity is the payment institution; the call shop is its agent. In practical terms: the institution answers for it, which is why it demands strict identification, limits and training. A careless agent is not risking just their commission — they are risking the contract.
Co-ownership entities (comunidades de bienes). Having no legal personality, they are treated like sole traders: outside the external expert exam, but subject to due diligence, record keeping and suspicious transaction reporting if the activity falls under article 2.1.
Non-residents without a permanent establishment. Obliged only when they carry out activity in Spain — and then with all the consequences. In the case of foreign entities operating in Spain under the freedom to provide services, the representative before SEPBLAC may be a non-resident.
